Snap-a-Meme Terms of Service

Welcome to Snap‑a‑Meme (“we,” “us,” “our”). These Terms of Service govern your use of our mobile app (“App”) and related services. By using the App, you agree to these terms. If you disagree, please don’t use the App.


1. Acceptance and Updates

1.1 Use of the App constitutes your agreement to these Terms, the Privacy Policy, and any additional terms (e.g., in‑app purchases).
1.2 We may modify these Terms. Changes become effective upon posting. Continued use after changes means acceptance.
1.3 We may notify you of significant changes via email or in‑app notices.


2. Eligibility

2.1 You must be at least 13 years old (or older in certain EU jurisdictions) to use the App.
2.2 We do not knowingly collect data from children under applicable ages. If discovered, we delete the data and terminate the account.
2.3 Children under the minimum age may only use the App with verified parental permission.


3. Account & Security

3.1 You may register via email or a supported service (e.g., Apple, Google). You are responsible for all activity on your account.
3.2 Keep your login credentials secure. Notify us immediately of unauthorized access or security breaches.


4. User Content

4.1 You retain ownership of images, content, or media you upload (“User Content”).
4.2 By uploading, you grant us a worldwide, non-exclusive, royalty-free, revocable license to use, process, display, and remove your content within the App’s functionality (e.g., meme creation, backups).
4.3 You represent that you own or have rights to the content you upload and that it does not violate laws or third-party rights.


5. Acceptable Use & Prohibited Conduct

5.1 You must not:

  • Violate laws or violate others’ rights (copyright, privacy, etc.).

  • Upload inappropriate, offensive, or illegal content.

  • Use the App maliciously, disruptively, or to manipulate metrics.

  • Reverse engineer, copy, modify, or distribute the App’s code or assets.

5.2 We reserve the right to remove content or suspend accounts at our discretion for violations.


6. Intellectual Property

6.1 The App, its content, designs, logos, and all related intellectual property are our property or licensed to us.
6.2 You may not copy, reproduce, sublicense, distribute, or create derivative works of our IP without explicit permission.


7. In-App Purchases & Payments

7.1 In-app purchases are processed by Apple’s App Store; we do not handle payment details.
7.2 Refunds are governed by Apple’s terms unless otherwise stated. Contact us for help with your Apple receipt or purchase status.


8. Disclaimers & Limitation of Liability

8.1 The App is provided “as-is,” without warranty of any kind. We do not guarantee uninterrupted access or error-free performance.
8.2 To the maximum extent permitted by law, we disclaim liability for damages arising from your use of the App, loss of data, or any indirect damages.
8.3 Our total liability, if any, is limited to the amount you paid within the app during the past 12 months (if applicable).


9. Indemnification

You agree to indemnify, defend, and hold us harmless from any third-party claims, damages, liabilities, or costs arising from your violation of these Terms or misuse of the App.


10. Governing Law & Dispute Resolution

10.1 These Terms are governed by the laws of Bosnia and Herzegovina, without regard to conflict of law principles.
10.2 For EU, UK, or California users, your local mandatory consumer protection laws apply.
10.3 Disputes may be resolved in local courts or via arbitration where allowed. Small claims and consumer rights are unaffected.


11. EU Consumer Rights & Transparency

11.2 You have rights to clear wording, no hidden clauses, and fairness in terms of price/quality expectations.


12. Digital Services Act (DSA) Requirements

  • During sign-up or purchase flow

14. Severability & Continuation

If any provision is invalidated, the remainder remains in effect. These Terms continue to bind past users even after termination.
